What it does

The Absentee Owner Land Tax Surcharge Calculator estimates the extra land tax an absentee or foreign owner pays on Australian land, on top of the ordinary land tax assessed on the same holding, for each state and territory that levies one.

The formula

Surcharge = aggregated taxable land value × state surcharge rate × ownership share; total = ordinary land tax + surcharge

How it works

It aggregates the taxable land you hold in one state, applies that state's ordinary land tax scale, applies the state's absentee owner surcharge percentage to the same aggregated value, and pro-rates both by your ownership share.

Where it is used

  • Estimating the absentee owner surcharge before buying
  • Comparing the surcharge across states and territories
  • Budgeting the annual holding cost of an investment property

Worked example

On A$900,000.00 of Victorian land, ordinary land tax is … and the absentee owner surcharge adds … — a total of … a year, or … a month.

What the absentee owner land tax calculator does

The absentee owner land tax surcharge is an extra annual charge that most Australian states apply to land held by people who live overseas, and this calculator estimates it alongside the ordinary land tax on the same holding. It is one of the largest recurring costs of holding Australian property from abroad, and it is frequently discovered only when the first assessment notice arrives.

Enter the taxable land value, choose the state and say whether you are assessed as an absentee or foreign owner. The result splits the annual bill into the ordinary land tax component and the surcharge component, and converts it to a monthly and weekly holding cost.

How land tax works before the surcharge

Land tax is a state tax on the unimproved value of land, not on the market value of the house standing on it. Your principal place of residence is normally exempt, so land tax generally falls on investment properties, holiday homes and vacant land.

Assessment is on the aggregate. All the taxable land you own in one state is added together and taxed on that combined figure, which is why a second modest property can push you well past the threshold. Each state publishes a scale of thresholds, fixed base charges and marginal rates, and the calculator applies the scale for the state you select to your aggregated value.

How the surcharge is added

The surcharge is a flat percentage of the taxable land value with no bracket structure. It does not replace the ordinary assessment; it sits on top of it. Because it is flat and often has no threshold, it frequently dwarfs the ordinary land tax on a mid-value holding.

The rates differ sharply between states. New South Wales charges the highest, Victoria and Queensland sit in the middle, Tasmania and the ACT are lower, and South Australia, Western Australia and the Northern Territory do not levy one at all. That spread is large enough to change which state an offshore investor should buy in, which is exactly what the state comparison in this tool is for.

Ownership share and joint holdings

Where land is held jointly, the assessment normally starts with the whole parcel and is then allocated. Enter your share in the advanced options and both the ordinary land tax and the surcharge are pro-rated accordingly.

Be careful with mixed ownership. In several states the surcharge applies to the foreign owner's interest even where the co-owner is an Australian resident, so a half share held by an overseas partner can bring the surcharge into a property that would otherwise pay none. The calculator handles the arithmetic; the classification is a question for the revenue office.

Reading the results

Five numbers matter:

  • The surcharge itself, which is the headline figure and the cost of your ownership status
  • The ordinary land tax, which you would pay regardless of where you live
  • The total payable, which is what the assessment notice will show
  • The effective rate against your land value, useful when comparing states
  • The after-tax cost, once the deduction on an income-producing property is allowed for

Compare the effective rate against the rental yield on the property. On a low-yielding holding in a high-surcharge state, the surcharge alone can consume a large share of the gross rent, which changes the investment case entirely.

Where the estimate is approximate

This is a model of the general case, and several refinements are left out deliberately rather than guessed at. Some states apply a surcharge-specific threshold before the charge starts; some restrict the surcharge to residential land while assessing ordinary land tax on all taxable land; some run separate scales for land held in trusts or by companies; and exemptions exist for particular land uses and for owners who take steps to develop or occupy the land.

The calculator also assesses a single state at a time. Land tax does not aggregate across borders, so an owner holding property in two states receives two separate assessments and should run the calculation twice.

How it differs from the foreign purchaser duty surcharge

The two foreign-owner charges are easy to confuse, and their financial weight is very different. Foreign purchaser duty surcharge is a one-off charge added to transfer duty when you buy, paid at settlement and folded into the purchase price. The absentee owner land tax surcharge is annual and open-ended: it is charged again every year you hold the land while your status has not changed.

Over a typical holding period the annual charge is usually the larger of the two. A one-off duty surcharge on a mid-value purchase is painful but finite, whereas a recurring surcharge on the same holding compounds into a much bigger figure across five or ten years. When you are testing whether an Australian purchase stacks up from offshore, model both, then multiply the annual surcharge by the number of years you realistically expect to hold.

Planning around the charge

If you are already assessed, the surcharge is largely fixed, but a few things are within your control. Keeping accurate records of your days in Australia matters where residency is tested by presence. Reviewing your holding structure before you buy is far cheaper than restructuring afterwards, because transfers attract duty. And where a property is genuinely income-producing, making sure the land tax and surcharge are claimed as deductions recovers part of the cost.

If the assessed land value looks wrong, most states allow an objection to the valuation within a set window after the notice issues. Because the surcharge is a flat percentage of that value, a successful objection reduces the surcharge proportionally, which makes the exercise more worthwhile for an absentee owner than for a local one.

All figures here are an estimate based on the state scales and surcharge rates shown above and on the simplifications described in this page. This is general information, not tax, legal or financial advice. Check your assessment notice and speak to a registered tax agent or the relevant state revenue office before acting on it.

Frequently asked questions

Who counts as an absentee or foreign owner?
Each state writes its own test, but broadly it captures individuals who are not Australian citizens or permanent residents and who do not ordinarily reside in Australia, along with foreign corporations and trusts with substantial foreign interests. Some states look at where you live during the year, others at your visa status, so the classification can differ between states for the same person.
Is the surcharge charged instead of ordinary land tax?
No, it is charged in addition. You are assessed for ordinary land tax on your aggregated holding in the state, and the surcharge is then applied on top. The calculator shows both figures separately and adds them together so you can see the split.
Which states charge a land tax surcharge?
New South Wales, Victoria, Queensland, Tasmania and the ACT all levy a surcharge on absentee or foreign owners, at rates that differ substantially between them. South Australia and Western Australia do not levy a land tax surcharge, and the Northern Territory does not levy land tax at all.
Does the surcharge have its own tax-free threshold?
In several states it does not. Ordinary land tax usually starts only once your aggregated holding passes a threshold, but a surcharge can apply from the first dollar of taxable value. This calculator applies the surcharge to the whole aggregated value, which matches the states with no surcharge threshold and slightly overstates the bill in the states that have one.
Is the surcharge tax deductible?
Land tax and the surcharge on an income-producing property are generally deductible against the rental income in your Australian tax return. Enter your marginal rate in the advanced options and the calculator will show the after-tax cost. Land held for private use is not deductible.
Can I avoid the surcharge by becoming a resident?
Status is assessed at a particular point in each land tax year, and several states allow an exemption or a refund where you become an Australian resident, or where the land is put to a qualifying use such as building housing. The rules are narrow and vary by state, so check with the relevant revenue office before relying on one.
How should I read the result?
Five numbers matter: The surcharge itself, which is the headline figure and the cost of your ownership status; The ordinary land tax, which you would pay regardless of where you live; The total payable, which is what the assessment notice will show; The effective rate against your land value, useful when comparing states; The after-tax cost, once the deduction on an income-producing property is allowed for. Compare the effective rate against the rental yield on the property.
